BoardgameMarketplace Terms of Service
Effective Date: September 16, 2026
Welcome to BoardgameMarketplace, a community marketplace where people buy, sell, and trade board games and accessories with each other. These Terms of Service ("Terms") are an agreement between you and BoardgameMarketplace LLC ("we", "us"), the operator of BoardgameMarketplace. By creating an account or using the site, you agree to these Terms. If you do not agree, please do not use the site.
1. Changes to These Terms
We may update these Terms from time to time. The date at the top shows when they last changed. If a change materially affects your rights, we will tell you in advance, by email or with a notice on the site. If you keep using the site after a change takes effect, the updated Terms apply. If you do not agree, you can delete your account at any time.
2. Eligibility and Accounts
You must be at least 18 years old to use BoardgameMarketplace. You sign in with your Facebook account. You agree to:
- Keep your profile details accurate, including your location.
- Use only one account, and not share it with anyone else.
- Take responsibility for everything done through your account.
- Tell us promptly if you believe someone else has used your account.
3. How the Marketplace Works
BoardgameMarketplace lets independent people list board games, find games near them, and talk to each other. We are not a shop, auctioneer, or agent.
- Deals are between users: Any sale or trade is an agreement between the buyer and the seller only. We are not a party to it.
- Payment and delivery are arranged by users: BoardgameMarketplace does not handle payments between users, and does not hold, inspect, pack, or deliver items. Buyers and sellers agree on payment and handover (in person or by post) themselves.
- No guarantees about listings or users: We do not check, and make no promises about, the condition, authenticity, completeness, safety, or legality of listed items, or whether a buyer will pay or a seller will hand over an item.
- For private individuals only: BoardgameMarketplace is for people selling or trading games from their own collection, not as a business or trader, and not on behalf of one (for example, a shop, a distributor, or anyone buying games to resell them for profit). We may remove listings or suspend accounts that appear to be selling as a business.
- Yearly limits: Depending on the country in your profile, we may limit how many games you can sell or trade each year. When you reach it, you may not be able to post new listings, or only trade listings, until the next calendar year.
- Sellers' responsibilities: Sellers are responsible for describing items honestly, for having the right to sell them, and for any taxes.
3.1 Problems Between Buyers and Sellers
If something goes wrong with a deal, such as an item not matching its description or not arriving:
- Talk to each other first: Buyer and seller should try in good faith to resolve the issue directly.
- What we can and cannot do: We do not mediate or decide disputes between users, and we cannot issue refunds or recover items. We do review reports of fraud or rule-breaking, and may warn, suspend, or remove accounts to protect the community.
- Other remedies: If you cannot agree, you may use the protections offered by the payment method you chose, or your local consumer-protection bodies or courts.
3.2 Trades
When trading is available, you can offer some of your listed games, with or without an amount of cash, in exchange for another user's listed games.
- A trade is an agreement between the two users only: As with a sale, we are not a party to it. The two of you arrange the handover yourselves, and any cash is paid in person at the handover.
- Values are estimates: The value shown on a trade-only listing is the seller's own estimate. It is not a valuation by us or a price either user must accept.
- Agreeing a trade: A trade is agreed when the other user accepts your offer. Every game in it is then reserved for the two of you, and other offers that include those games are closed.
- Finishing a trade: Once you have met and swapped, either of you can mark it as swapped, and the other confirms. If the other user neither confirms nor calls it off within 7 days, the trade is marked complete. Only mark a trade as swapped if the swap really happened.
- Calling a trade off: Either of you can say the trade fell through before it is complete. Its games then go back on sale.
- Reviews: After a trade, each of you can review the other once. If a trade is called off after one of you said you had swapped, that person can still leave a review, but it is labelled as unconfirmed and does not count toward the rating.
- Taxes: Some countries treat a trade like a sale for tax purposes. You are responsible for any taxes that apply to you.
4. Prohibited Items
You may not list or offer:
- Counterfeit, bootleg, or unauthorized copies of games or components.
- Stolen items, or items you do not have the right to sell.
- Anything that is illegal to sell or send where the buyer or the seller lives.
- Items that are not board games, tabletop games, or related accessories.
Any photos must show the actual item you're offering, not stock images or AI-generated pictures.
5. Your Content and Conduct
You keep ownership of the photos, descriptions, messages, and reviews you post. You give us a worldwide, non-exclusive, royalty-free licence to host, display, copy, and resize that content, only as needed to run and promote BoardgameMarketplace. The licence ends when you delete the content or your account, except for copies other users already have (such as messages you sent them), content we must keep by law, and reviews and completed listings, which stay on the site without your name (see the Privacy Policy).
You agree not to:
- Post content that infringes other people's copyright, trademarks, or other rights (for example, publishers' artwork you do not have permission to use).
- Deceive or defraud other users, including fake listings, fake reviews, falsely marking a trade as swapped, or misleading messages.
- Harass, threaten, or abuse other users, or post hateful content.
- Use another user's contact or delivery details for anything except completing your deal with them, or pass them on to anyone else.
- Send spam, or use bots or scrapers on the site (including to collect content for training AI), or try to break or overload it.
6. Reporting Content
You can report a listing, message, or user with the "Report" option, or through our Support page. This includes notices that content infringes your copyright or is illegal. We review reports, may remove content or restrict accounts, and will tell the user concerned why, unless the law or safety reasons prevent it. If you think we got a decision wrong, you can ask us to look at it again through the Support page.
Please report only content you believe breaks these Terms or the law. We may ignore reports from accounts that misuse the Report option.
6.1 Copyright Complaints
If you believe content on BoardgameMarketplace infringes your copyright, tell us through our Support page, or by email to [email protected] with the subject "Copyright notice". Please include: your contact details; the work you say is infringed; the content and where it is on the site; a statement that you believe in good faith that its use isn't authorized by the owner, their agent, or the law; and a statement that your notice is accurate and that you own the copyright or are authorized to act for the owner.
If the notice is complete, we remove the content or hide it, and tell the user who posted it. If your content was removed and you believe that was a mistake, you can send us a counter-notice the same way, explaining why. We close the accounts of users who repeatedly infringe others' copyright.
7. Our Intellectual Property
The site's design, logo, code, and our own content belong to us and are protected by law. You may not copy, reverse engineer, or reuse them without our written permission. Game names, artwork, and information belong to their publishers and other owners.
8. Suspension and Account Deletion
We may suspend or close an account that breaks these Terms or harms other users, and we will tell you why unless the law or safety reasons prevent it. If we suspend or close your account, you may not use another account, or someone else's, to get around it. You can stop using the site and delete your account at any time from your profile settings.
9. The Site Is Provided "As Is"
We work to keep BoardgameMarketplace running and secure, but we provide it "as is" and cannot promise it will always be available, error-free, or that information on it (such as game data or distances) is accurate.
10. Limitation of Liability
To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost data, or for losses arising from deals or contact with other users. Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.
11. Indemnification
To the extent the law allows, you agree to cover our reasonable costs (including legal fees) arising from claims by others caused by your breach of these Terms or your deals with other users.
12. Governing Law and Disputes With Us
Please read this section carefully, as it affects your legal rights.
- Governing law: These Terms are governed by the laws of the state of Wyoming, USA.
- Your consumer rights: If you live in the European Union, the United Kingdom, or another country whose consumer laws cannot be waived, you keep the protections of those laws and may bring a claim in the courts where you live.
- Courts: Any dispute with us that we can't resolve with you informally will be decided by the state courts in Sheridan County, Wyoming, USA, or the federal court for the District of Wyoming, and you and we agree to those courts' jurisdiction. Either of us may instead bring a claim that qualifies in a small-claims court where you live.
13. General
These Terms and our Privacy Policy and Cookie Policy are the whole agreement between you and us about the site. If part of these Terms cannot be enforced, the rest still applies. If we do not enforce a right straight away, we do not give it up. You may not transfer your rights under these Terms; we may transfer ours to someone who takes over the site, and will tell you if we do.
